Laid off? How severance is taxed
#Layoffs are heartbreaking. Beyond the emotional impact, there’s an immediate #financial question:
Does the #government provide any #tax relief in such situations?

Most severance structures include:
1️⃣ #Severance Pay
Fully taxable, Added to your income, Taxed as per your slab!
No Relief Here.
2️⃣ #Gratuity
Exemption = minimum of the following:
- Actual gratuity received
- ₹20 lakh (lifetime limit)
- 15 days’ salary × years of service
Important nuances:
- Eligibility is usually 5 years of continuous service (definition of 5 years varies from company to company)
- Some employers may still pay gratuity even if eligibility isn’t met, especially in the case of Layoffs. So please check with the HR team once
- ₹20 lakh is a lifetime cap across employers
👉 Anything beyond that is taxable
3️⃣ #LeaveEncashment
Exempt under Section 10(10AA), up to ₹25 lakh (lifetime limit)
Exemption = minimum of:
- ₹25 lakh
- Actual amount received
- Average salary (last 10 months)
- Cash equivalent of leave (max 30 days/year)
Things to note:
- Usually calculated on Basic + DA (not full CTC)
- Companies may use 22 vs 30 days/month, impacting payout
Layoffs take an emotional as well as a financial toll on the person, with
- No unemployment benefits/Social Security
- Limited tax relief
- Immediate financial pressure (EMIs, rent, school fees)
What can the government do to make things better?
If a full tax exemption isn’t feasible, can there at least be tax deferment during #JobLoss?
Even temporary relief can make a meaningful difference.
As the saying goes:
“Doobte ko tinke ka sahara hi kaafi hota hai.”
For someone navigating uncertainty, even small support can go a long way.
Remember, the Salary class has been paying taxes most honestly throughout their earning journey!
In uncertain times, it is always advisable to recheck your #EmergencyFund. An emergency fund should manage your expenses for at least 9-12 months, including regular as well as one-time expenses.
